Terms of Use

These terms cover the use of BlindSpots ("the Service"), operated by Lab352. Please read them before taking part in or arranging an interview through the Service.

Who these terms apply to

Two different people use the Service, and not every term applies to both.

• Organisations — the company, recruiter or interviewer who arranges an interview and receives its results. If You agree to these terms on behalf of an organisation, You confirm You are authorised to do so, and "You" means that organisation.
• Candidates — the person attending the interview. A candidate did not choose the Service and is not a customer of it. The sections headed Recording, Acceptable use and What the Service reports apply to candidates. The commercial sections do not.

What the Service does

The Service provides a browser-based page through which a candidate joins an interview, and reports signals about that session to the organisation that arranged it. It does not conduct interviews, assess candidates, or take part in hiring decisions.

What the Service reports

The Service reports signals, not conclusions. It observes things such as the interview window losing focus, content being pasted, or characteristics of the device being used, and it passes what it observed to the organisation conducting the interview.

A signal means the Service observed something. It does not mean a candidate did anything wrong. Ordinary and innocent behaviour can produce signals, and so can unusual hardware, assistive technology, network conditions and browser configuration. The Service can also fail to observe things.

The organisation decides. Signals are information for a person to weigh, not a determination of misconduct and not a recommendation. The organisation conducting the interview is solely responsible for how it interprets this information and for any decision it takes. Lab352 makes no hiring, screening or eligibility decision about any candidate.

Organisations agree not to present output from the Service as proof of misconduct, and to give a candidate a fair opportunity to respond before acting on it.

Recording

Taking part in an interview through the Service involves recording. What is captured, why, and for how long is set out in our Privacy Policy.

Recording requires Your browser's permission and cannot happen without it. If You prefer not to be recorded, You may decline, and should contact the organisation that arranged Your interview to make other arrangements.

Organisations are responsible for telling candidates that an interview will be recorded, and for obtaining any consent required where they operate, before the interview begins.

Acceptable use

You agree not to:

• interfere with, circumvent or disable any part of the Service, including its detection features;
• use the Service to record a person who has not been told the interview is recorded;
• attempt to access interviews, recordings or results that are not Yours;
• reverse engineer, resell or redistribute the Service;
• use the Service unlawfully, or to harass or discriminate against anyone.

Availability

The Service is provided as it is, without any guarantee of availability. It depends on third parties including Zoom and Google, and can be interrupted by them, by maintenance, or by faults. Interviews are time-sensitive, so organisations should be prepared to continue an interview by other means if the Service is unavailable.

Recordings and results

Recordings and results of an interview belong to the organisation that arranged it. Lab352 holds them to operate the Service and does not sell them or use them for advertising.

Everything else in the Service — the software, its design and its documentation — remains ours.

Ending use

An organisation may stop using the Service at any time by disconnecting its accounts. We may suspend or end access where these terms are breached, or where continuing would be unlawful.

Requests about deleting data are handled as described in the Privacy Policy.

Liability

To the extent the law allows, Lab352 is not liable for indirect or consequential loss, for hiring decisions taken by an organisation, or for loss arising from the Service being unavailable or from a signal being wrong. Nothing here limits liability that cannot lawfully be limited.

Changes

We may update these terms. The date at the top shows when they last changed, and continuing to use the Service after a change means accepting it.
